User is a person who views the website. Owner of the site is Heather Cushing-Gordon, who pays Wixx for the site and GoDaddy for the domain.
Terms of Service
a) What can a user do on www.heathercgordon.ca

e) Jurisdiction:

The Client may be from anywhere else in the world

Zoom Meetings will be used to connect to live meetings between the Client and the Owner

Online documentation shares (Google Drive) will be used to house common materials
f) Dispute Resolution:

Should the Client have concerns regarding any part of the service being provided, they should speak directly to the Owner about their concerns
-
If the Client would prefer to email their concerns they can do so via hcushing.gordon@gmail.com

The Owner will return to the Client within 24 hours of the dispute and claim being made with options that the Client can determine might best suit the circumstance in an effort to resolve the situation
-
If the unfortunate circumstance occurs where the Owner and the Client cannot come to an agreement to end the dispute a third party will become involved to support a resolution. The third party becoming involved will likely incorporate a fee. Should the Client seek legal advice, they will be solely responsible for the fees associated with that support.

If at any point during the contract period the Client is injured during sessions and/or is injured during any of the exercises that are suggested between direct Client/Owner meetings on Zoom, the Owner is not responsible for these injuries. It is recommended that the Client make every effort to make judgment calls in the moment that protects themselves from injury.

The Owner cannot guarantee that the Client will make gains expected from the program, the Client must make every effort to commit to the work requested in order to see any significant changes during the duration of the contract.

Though at the onset of the coaching program the Owner discusses and outlines specific goals that the Client agrees to, the Owner is not responsible for achieving these goals for the client and cannot guarantee the Client will achieve them by the end of the duration of the program nor beyond the end of the program.

For Downloadable Items

The printable and/or downloaded items have been created with the intention to provide benefits to the Client, however in some cases benefits are not reached for the Client which is not the fault of the Owner

The Owner is not responsible for any harm that befalls the Client due to the use of the downloaded item

The Owner is not responsible for any Client regression or for the Client not gaining the skills that the downloaded item is intended to increase.

If at any point during the use of the downloaded item the Client is injured during any of the exercises that are suggested, the Owner is not responsible for these injuries. It is recommended that the Client make every effort to make judgment calls in the moment that protects themselves from injury.

The Owner cannot guarantee that the Client will make gains expected from the downloaded item, the Client must make every effort to commit to the work suggested in order to see any significant changes while using the downloadable item.

Though the Owner is the author of the item, the Owner is not responsible for achieving the goals for the client and cannot guarantee the Client will achieve them by the end of the use of the item

Privacy Policy

Types of Information that is Collected from using my site, but all is optional:

When/if you make a purchase I will collect - Contact information, credit card information, address - through SamCart (which is my processor for ecommerce).

I use this information solely for you making a payment for a service/product and also for me to connect with you after if necessary

I only set up the commerce site to collect address information if I intend to use it for sending you something or if during coaching I will sending you a care package upon purchase

2. Cookies, Pixels or Tracking Signals

It is not an intentional part of my Wixx hosted site to collect this information or do anything with this information

Please be aware that it is likely being collected by a third party, what that third party does (Wixx, SamCart, Stripe, Etsy) is not of my knowledge
3. MailChimp

I use MailChimp on occasion to collect information for my mailing list

This is a tool I use to help me manage my mailing list and they are going to have access to your personal information as well
4. Spam Compliance

The reason that I use MailChimp or I use very strict questioning about whether I can send you emails when I collect information from you (i.e. like when you join my free support groups) is because I want you to be aware that I will likely send you sales emails and contact emails and newsletters.

Each email that I send will say “I no longer wish to receive this email, please take me off your list. Reply to this email if that is the case.” or will be sent through MailChimp where you can select to not receive emails from my email account.
5. Children’s Privacy

I am not in the business of children’s services through this site

I do not collect information about minors

If I happened to have collected something in error, I will immediately delete it from any source it may have come through

I use a special password for each of my business site suppliers - Wixx, Stripe, SamCart, Etsy, Facebook, Instagram, Pinterest

Each password is stored in a special, locked location on my phone

After a client has determined they no longer wish to work with me, I will remove them from my mailing list

After a recipient of my emails has determined they no longer wish to receive emails from me, I will remove them from my mailing list

I keep client information on file for 7 years from the last date of interaction for all coaching clients

Once I have reached the 7 year period I will destroy the information collected

All confidential information is stored in a password protected file on my computer that only I know the password to

Destruction

All computer files will be destroyed by deleting my file from my documents and then deleting the file from my computer through the recycle bin on my desktop

All names and contact information in MailChimp will be deleted from my MailChimp account

What happens if there’s a breach?

If I become aware that there has been a breach of information, I will immediately contact the person whose information has been contacted by an outside source

I will recommend that they immediately change their passwords

I will do all I can to support the authorities in identifying the entity who was responsible for the breach
